The agreement between you, as a client of Mr. Pratekk Malviyaa, and Fititude, a fitness institute located in Pune, Maharashtra 412207, pertains to your participation in their training programs and courses. Mr. Pratekk operates the fitness center, and the services provided are subject to the following terms. These terms may be revised without notice and will be specified through changes made herein periodically.
1. These are the terms and conditions for using the fitness programs and services provided by Fititude. By enrolling or agreeing to these terms, you agree to waive any and all claims against Fititude, its affiliates, trainers, agents, officers, directors, or employees arising out of your use of the Fitness Programs or any services therein. If you do not agree, you may not use the services. Fititude may, at any time, modify these Terms/this Agreement without prior notice and your continued use of this program shall be conditioned upon the terms and conditions in force at the time of your use.
2. Neither Fititude nor any Trainer/Consultant shall be obliged to provide any services otherwise than in compliance with applicable laws. Any advice/regiment/diet provided by any trainer/consultant shall depend solely on the accuracy of the information provided by you.
3. We strive to give our best effort in creating a plan that caters to your physical health and fitness goals. However, we cannot ensure any specific weight loss progress within a given timeframe, nor can we guarantee any particular outcome. Our primary objective is to provide you with the most suitable plan possible. It’s important to note that we cannot guarantee to remedy any pre-existing health conditions.
4. You shall be granted unobstructed access to your designated coaches. However, kindly note that our coaches shall not be available on Sundays and National Holidays. For any inquiries concerning your fitness regimen, our coaches/trainers shall respond to you with promptness at their earliest practicable opportunity.
5. Fititude hereby declares that it neither employs nor endorses the use of any prohibited supplements or drugs, or any controlled substances whatsoever. If you choose to take any supplements voluntarily, we request that you disclose this information to us. Failure to do so will absolve Fititude of any liability in the event of any untoward consequences arising from the plan customized for you.
6. You acknowledge that you have either had a physical examination and been given your physician’s permission to participate, or that you have decided to participate in an activity and use of equipment, machinery, and programs designed by Fititude without the approval of your physician and do hereby assume all responsibility for your participation and activities, and utilization of equipment and machinery in your activities.
7. The Fititude does not provide professional medical services or advice. The services provided by the Fititude coaches on the website should not be interpreted as medical advice or opinion, and do not create a doctor-patient relationship. Use of the services is not for medical emergencies. If you think you have a medical emergency, consult your doctor.
Your use of the services does not create a doctor-patient relationship between you and any of the Fititude parties (including, without limitation, coaches) or any of the Fititude service users.
8. Neither Fititude nor any coaches/trainers shall assume any liability or responsibility for any claims, damages, consequences and/or orders of any statutory bodies or consumer forums not arising from any default or negligence on the part of Fititude or the relevant coach/trainer, as the case may be.
9. In no event shall Fititude, its coaches, its trainers, its agents, its suppliers, or any third parties recommended by Fititude, be liable for any damages of whatsoever nature, resulting from the use of or inability to use the products and services, whether based on warranty, contract, tort, or any other applicable law. Fititude is not liable for any personal injury, including death, caused by your use or misuse of the website.
10. We accept credit cards, debit cards, net banking, mobile wallets, UPI, PayPal & stripe. GST will be added to the price of purchases as deemed required by us. We may change prices at any time.
11. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the website. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. We bill you through an online billing account for purchases made via the website.
We reserve the right to refuse any order placed through the website.
- GOVERNING LAW AND JURISDICTION: This Agreement is governed by and is to be construed in accordance with the laws of the Republic of India. Any suit, action or proceeding seeking to enforce any provisions of, or based on any matter arising out of or in connection with, this Agreement or the Transactions may be brought in a court sitting in Pune, India, and each of the Parties hereby consents to the non-exclusive jurisdiction of such courts.
- ARBITRATION: In case of any dispute or difference arising out of or connected with or relating to this Agreement/these terms, the same shall be referred to arbitration under Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof for the time being in force. The arbitration shall be referred to one arbitrator who will be appointed by Fititude. The venue of Arbitration will be Pune, Maharashtra 412207
